Abstract

The objectives to be achieved in this research are: To review and analyze the policy of criminal sanctions against narcotics users in Indonesia as well as the implementation of assessments of narcotics users. This study uses a constructivism paradigm with a normative juridical approach to solving research problems by examining secondary data obtained through library research on Indonesian laws and regulations governing narcotics, books, research results and journals. The data obtained were then analyzed using descriptive analytical methods. The results of the research show that it is difficult to position narcotics users as perpetrators or victims of narcotics crimes. If you are positioned as a perpetrator, you will be subject to criminal penalties and if you are positioned as a victim, you will be directed to rehabilitation. The assessment of narcotics users in Indonesia is carried out by a team of psychological evaluation assessments, detoxification programs, motivational interviews, brief interventions, maintenance therapy (not carried out within the National Narcotics Agency), and inpatient rehabilitation and counseling.
